Leal, in front of Presiding Judge Alia Moses Ludlum, a Not Guilty Verdict was returned on a Federal Criminal charge of Conspiracy/Possession Drug. Mistrial

On February 28, 2007 in the United States of America v. L. Carlson, in front of Presiding Judge Alia Moses Ludlum, a Mistrial resulted after the Jury deliberated without being able to come to a verdict on a Federal Criminal charge of Failure to Declare/False Statement. The mistrial resulted in the Western District of Texas – Del Rio, Val Verde County, Texas. Michael J. Bagley represented the Defendant.

Mike Bagley successful in fed.defense of clients.

Former Eagle Pass Attorney, Michael J. Bagley was able to successfully obtain a mistrial for his client Lisa Lynn Carlson in Del Rio in the United States District Court in the Western District of Texas before U.S. District Judge Alia Moses Ludlum. Mr. Bagley’s client was charged with Failure to Declare/ Making a False Statement to a Federal Officer/ Agent, which is a federal criminal offense.

In a separate federal criminal case, Mr. Bagley was able to secure a dismissal on a drug related case after filing a Motion To Suppress. This case was held in front of Senior U.S. District Judge William Wayne Justice on August 14 for a hearing and Judge Justice eventually granted the Defendant’s Motion to Suppress. On October 15, a separate Order To Dismiss was issued by Judge Justice on November 7 dismissing the criminal charges against Mr. Bagley’s client and the two ( 2 ) co – defendants.

Mr. Bagley’s client in this case was Jesus Antonio Hernandez Martinez of Cd. Acuna and he was charged with Conspiracy To Possess Marijuana With The Intent To Distribute. The Motion To Suppress was in reference to the stop of his client’s motor vehicle and his subsequent statement to law enforcement officers and / or Agents.

Bagley successfully defends EP businessman in fed. ct.

Michael J. Bagley was recently able to yet again successfully represent and defend one of his clients in federal court.

On Friday, December 6 the United States government filed a Motion To Dismiss in the case of U.S.A. vs. Juan Jesus ” Chico ” Hernandez and U.S. District Court Judge Alia Moses Ludlum executed the Order Of Dismissal on the same date.

Mr. Bagley’s client Juan Jesus ” Chicho ” Hernandez , resides in Eagle Pass and operates the family business / store, Casa De Chicho. He was charged by a Federal Indictment of Threatening A Federal Agent / Officer. The Making A False Statement To A Federal Agent / Officer.

The Government Filed its Motion To Dismiss Stating that the case Was not readily provable after it Conducted an investigation of the Facts and witnesses, which was After the case had been filed.

Bagley and his client are considering the possible filing of a civil law suit for frivolous or Wrongful prosecution to seek Damages for attorney’s fees, mental anguish, loss of reputation and / or business loss. Hernandez was indicted by the Government on August l, 2007 for incidents, which allegedly occurred on or about July 21, and July 25, 2007 in Eagle Pass and the was concluded on December 6,2007.

JUDGEMENT OF ACQUITTAL BY JURY

On August 8, 2013 in the State of Texas v. J. Morales, in front of Presiding Judge Robert E. Cadena, a Not Guilty Verdict on two counts of sexual assault was rendered by a jury in the 83rd Judicial District, Del Rio, Val Verde County, Texas. Attorney Michael J. Bagley represented the Defendant.

ORDER OF DEFERRED ADJUDICATION

On December 13, 2013 in the State of Texas v. G. Esparza, in front of Presiding Judge Robert E. Cadena an order of deferred adjudication was agreed upon in a case of 1st degree Felony, Aggravated Sexual Assault. The Defendant was placed on community supervision for a period of 10 years. This deferment was ordered in the 83rd Judicial District, Del Rio, Val Verde County, Texas. Attorney Michael J. Bagley represented the Defendant.

On January 8, 2014 in the State of Texas v. D. Cervantes, in front of Presiding Judge Enrique Fernandez, a Not Guilty Verdict on two counts of indecency with with a child by contact was rendered by a jury in the 63rd Judicial District, Del Rio, Val Verde County, Texas. Directed Verdict of Not Guilty

On August 23, 2022, in Fort Stockton (Pecos County) Texas, in front of 83rd Judicial District Judge Robert Cadena, I secured two directed verdicts of “Not Guilty” on two state criminal cases being brought against my client Casey Ann Gregory Free. Miss Free was charged with a 1st Degree Felony of Manufacturing & Delivery of a Controlled Substance and a 3rd Degree Felony of Unlawful Possession of a Firearm by a felon. If convicted, Miss Free would have been looking at a term of at least 5 years imprisonment up to 99 years or life imprisonment. After a short day and a half of testimony in front of an empaneled jury, Judge Cadena granted my motion for a Directed Verdict and the Judge instructed the jury to return with 2 verdicts of Not Guilty. After hearing the evidence presented at the trail, Judge Cadena found that State/District Attorney office of Ori T. White, the elected District Attorney for the 83rd Judicial District covering Pecos County, did not prove their respective cases as a matter of law.
