Mediation
The Mediation process is completely voluntary; all parties involved must agree to take part in the discussions.
The Mediation process is considered a non-binding process. In mediation, none of the parties involved in the discussions is obligated to reach any agreement that is legally binding. Instead the goal is to bring all parties together, in a neutral, relaxed, and non-judgmental environment so each party can confidentially present their respective positions in front of a neutral party.
Attorney Michael J. Bagley of The Bagley Law firm is a certified and trained Mediator who will work to assist with the communication between the parties. In his role as a mediator, Michael J. Bagley will not give legal advice during the mediation sessions. And, he will not make any legal conclusions about the positions taken by any of the involved parties.
Instead, Michael Bagley will act as an unbiased ‘bridge’ to help the parties speak openly and honestly to one another and help each party understand the positions and concerns of the other party. He will not ‘take sides’ on any of the issues but will will strive to help both parties come to a common understanding and agreement on the issues.
With over 30 years of experience as a Attorney, County Attorney and District Attorney, Michael J. Bagley is experienced in listening to any concerns or questions that arise. Arbitration
The Arbitration process is completely voluntary. In arbitration, all parties involved must agree to take part in the discussions.
If Mediation isn’t successful, if the parties involved simply cannot agree on a resolution to each of the issues, then Arbitration would be the next step in the process of resolving the issues without having to go to court.
Arbitration is typically considered to be a binding process where the arbitrator will take on a role, much like a Judge, to make decisions about the issues involved and give written opinions, which can be binding or non-binding.
Michael J. Bagley, is a certified and trained Arbitrator and with over thirty years of experience as a licensed, practicing Attorney. In his role as Arbitrator, Michael J. Bagley will review the evidence and testimonies that are presented and then apply all applicable laws to make an unbiased decision on each of the outstanding issues.
Agreeing to Mediation-Arbitration
